PUGS Golf Liability Waiver & Release Agreement

Effective Date: 8/1/2025

By participating in any activity involving the PUGS Golf mobile simulator (the “Simulator”), you agree to the terms of this Liability Waiver and Release Agreement (the “Agreement”). This Agreement is a binding legal contract between you (the “Participant”) and PUGS Golf, LLC (“PUGS Golf,” “we,” “us,” or “our”).

1. Assumption of Risk

By entering the simulator area and/or participating in any activity involving PUGS Golf equipment or services, you acknowledge and agree that:

  • Golf involves physical activity and the use of heavy and potentially dangerous equipment.

  • Activities may involve swinging golf clubs, striking golf balls, standing on simulated turf surfaces, and being in close proximity to other participants.

  • Participation may result in injury, including but not limited to: strains, sprains, contusions, fractures, head injuries, or other physical harm.

  • There is a risk of property damage to personal belongings, equipment, or nearby structures.

  • You are participating voluntarily and fully accept all risks, whether known or unknown, associated with these activities.

2. Release of Liability

You hereby release, waive, discharge, and hold harmless PUGS Golf, its owners, employees, contractors, partners, event hosts, venue owners, and affiliates from any and all liability, claims, demands, causes of action, or damages arising out of or related to any injury, loss, or damage that may occur as a result of:

  • Your use of the Simulator or other PUGS Golf equipment

  • Your participation in any PUGS Golf activity or event

  • Actions or negligence of PUGS Golf or any other participant

This release applies to all claims, including those arising from ordinary negligence, to the fullest extent allowed by law.

3. Medical Declaration

You affirm that:

  • You are in good physical condition and capable of safely engaging in golf-related activities.

  • You do not have any medical condition or injury that would prevent safe participation.

  • You assume all costs of any medical care needed as a result of your participation.

If you are unsure about your health or physical capabilities, you agree not to participate until consulting a medical professional.

4. Minors

If you are under the age of 18, you may not participate unless a parent or legal guardian has reviewed and accepted this Agreement on your behalf.

Parents or guardians agree to:

  • Supervise their child(ren) at all times

  • Assume full responsibility for any injury, loss, or damage caused by or to their child

  • Release PUGS Golf from liability on behalf of their child

5. Rules and Conduct

You agree to follow all posted instructions and verbal guidance from PUGS Golf staff. Failure to comply may result in immediate removal from the simulator area with no refund.

You agree to:

  • Use all equipment only as intended

  • Swing clubs only when it is safe to do so

  • Not engage in horseplay, reckless behavior, or conduct that may endanger others

6. Damage to Equipment

You agree to treat PUGS Golf’s equipment and simulator with care. You accept responsibility for any damage caused by misuse or negligence and agree to compensate PUGS Golf for repair or replacement costs.

7. Media Release

You acknowledge that PUGS Golf may capture photos or videos at events for promotional, advertising, and social media purposes.

By participating, you grant PUGS Golf the right to use your image, likeness, voice, or performance in any media format, without compensation or further permission.

If you do not consent to this, please notify a staff member before participating.

8. Indemnification

You agree to indemnify and hold harmless PUGS Golf from any and all claims, actions, suits, procedures, costs, expenses, damages, or liabilities brought as a result of your participation, including attorney’s fees and legal costs.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota. Any legal action shall be brought in the appropriate courts located in Hennepin or Ramsey County, Minnesota.

10. Agreement to Terms

By entering the simulator area, participating in any activity, or using PUGS Golf equipment or services, you confirm that:

  • You have read and understood this Agreement in full

  • You voluntarily accept all terms and conditions

  • You acknowledge that this waiver is legally binding

  • You are at least 18 years of age or have the consent of a parent/legal guardian

If you do not agree to these terms, do not participate in any PUGS Golf activities or use the simulator.
